DigiSMEHub is a multi-tenant business management platform designed for small and medium enterprises (SMEs). It provides modules for invoicing, customer relationship management, inventory, payroll, accounting, project management, and other business operations.
3. Account Registration
To use the Platform, you must:
- Create an account with accurate and complete information
- Be at least 16 years of age
- Maintain the security of your account credentials
- Notify us immediately of any unauthorised use of your account
You are responsible for all activities that occur under your account.
4. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws
- Upload or transmit viruses, malware, or other malicious code
- Attempt to gain unauthorised access to any part of the Platform
- Interfere with or disrupt the Platform's infrastructure
- Scrape, crawl, or use automated tools to extract data from the Platform
- Impersonate any person or entity
- Use the Platform to store or process data that violates third-party rights
5. Your Data
You retain ownership of all data you enter into the Platform. By using our services, you grant us a limited licence to store, process, and display your data solely for the purpose of providing the Platform's functionality.
We will handle your data in accordance with our Privacy Policy.
6. Subscription Plans & Billing
The Platform offers various subscription tiers with different feature sets and usage limits. Free tier users are subject to the limitations described on our pricing page. Paid subscriptions are billed according to the plan selected. We reserve the right to modify pricing with reasonable notice.
7. Intellectual Property
The Platform, including its design, code, features, and content (excluding your data), is the property of DigiSMEHub and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform.
8. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of scheduled maintenance.
9. Limitation of Liability
To the fullest extent permitted by law, DigiSMEHub shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of the Platform.
Our total liability for any claims arising from your use of the Platform shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
10. Disclaimer of Warranties
The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Termination
You may terminate your account at any time. We reserve the right to suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Platform ceases, though we may retain certain data as required by law or legitimate business purposes.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which DigiSMEHub operates, without regard to conflict of law principles.
